We have in the past, been asked to "stretch" what the law says, to make businesses believe that they were required to do more than the law says, but we refuse. Nor will we assist businesses or other covered entities to avoid meeting their ADA obligation. WE WILL NOT PUT OUR REPUTATION AND INTEGRITY AT RISK ! We believe for the most part that the ADA is a good law as it is and if changes need to be made to it then we believe in working for change using the proper avenues, NOT by being dishonest. For this reason we have adopted the following Code of Ethics.
ADA CONSULTANT’S CODE OF ETHICS
Consultants, whether they are individuals with a disability or not, Shall remain unbiased.
While Consultants should encourage and support a client's decision to exceed existing access requirements they Must Never represent that existing laws and standards require more than is actually contained in those laws and standards.
Consultants Must Never aid a client to intentionally avoid, or even attempt to avoid, compliance with the ADA and other existing laws and standards related to access for people with disabilities.
Consultants Shall Never represent that a client is “100% ADA Compliant” or “ADA Certified” even if they follow the consultant’s recommendations. Only the US Courts and the Federal enforcement agencies have the authority to determine compliance.
Consultants Shall Never represent themselves as employees or agents of the US Department of Justice, Equal Employment Opportunity Commission or other Federal ADA Enforcement Agency.
If a Consultant is an individual with a disability, they should draw on their personal knowledge and experience to creatively improve access and work toward greater compliance.
It is the Consultant's responsibility to accurately report on the client’s current level of access and both the consultant and the client must recognize that this could include information that may not always be favorable to the client.
Consultants Shall Make recommendations for access improvements that are consistent with current laws and standards, that meet the client’s needs and that show a creative response to access and compliance.
Consultants Shall Not receive monetary compensation from compliance or universal design related vendors that may give even the appearance of bias or preference related to the consultant’s recommendations for access improvements.
